It's a pain you have to do it though


Yeah...well its also nice to be able to use that option when you have a real offense....like speeding in your E90. And not waste it...because someone was 2 steps from the side walk.

Now I need to be on my best behavior for the next 12-18 months..or however long that period is.

My dads a MD as well. He seems to always get out of tickets as well.

HAha. What's wrong with an Explorer? I actually think it's a really cute SUV. When I went skiing with my friends, their parents rented out an Explorer and those things are so cuuuutee. My best friend drives a blue one and it's sucha cute car with teh whole tv and eddie bauer thing going on. I'd drive it

I don't think it is actually illegal to wait for the pedestrian to go past your car and turn. I'm pretty sure there is nothing in the VC which says that you cannot turn while the pedestrian is still in the crosswalk, as long as you actually give him the right of way. I would look into fighting it.

I just got an illegal tint ticket. The cop pulled me over only for that, and my tint is actually pretty light, 35%. The world is now that much safer...

Sucks for you man, thats some BS ticket. One the way down to SD friday night I almost got pulled over 2 different times, but both times saved by some other dumbass who made bigger violations. First I pulled in the gas station on Sand Canyon right off the 5, but I made an illegal left crossing solid double yellows, and saw two cops hiding in the dark in front of me. They both pulled out and turned on their lights and I thought I'm a gonner. They pulled into the gas station behind me, but got behind an IS instead and proceeded to give the driver a field sobriety test.

Then on 5 south, I was going about 95, and all of a sudden saw a CHP in front of me, I broke out in cold sweat and tapped on the brake and slowly pulled behind him. He changed lane immediately and I thought he was going to slow down to get behind me, but instead, he sped up, pulled into carpool and dragged a red IS (again!) to the side. I was going 80 the rest of the night.

In CA, you HAVE to wait until the ped clears the sidewalk. Meaning, from the moment they step off the curb to the time they get back on, you cannot turn. But usually cops don't trip as long as the peds are far from you.

No, you don't. You're just repeating something you heard somewhere. There is nothing in the vehicle code that says that, all it says is that you have to give pedestrians the right of way, although cops don't necessarily know that.

Take a look at the code section which you have supposedly violated. I'm willing to bet it is that 21950(a). If you can get the cop to admit that you waited for the pedestrian to cross and he was well past you, you have fulfilled the code requirements and you have an excellent chance of winning your case. If it is not 21950(a), read the section that he claims you violated carefully. I bet you find an out.

Read this, its left up to the cop to interprete the meaning of this code. And thus, anytime a pedestrian is within the crosswalk, the cop can claim that he determined you didn't exercise enough caution. Unless you can prove otherwise with photo or video, you're not going to win any points in the traffic court. Just pay the fine, go to traffic school and call it bad luck.

Right-of-Way at Crosswalks


21950. (a) The driver of a vehicle shall yield the right-of-way to a pedestrian crossing the roadway within any marked crosswalk or within any unmarked crosswalk at an intersection, except as otherwise provided in this chapter.

(b) This section does not relieve a pedestrian from the duty of using due care for his or her safety. No pedestrian may suddenly leave a curb or other place of safety and walk or run into the path of a vehicle that is so close as to constitute an immediate hazard. No pedestrian may unnecessarily stop or delay traffic while in a marked or unmarked crosswalk.

(c) The driver of a vehicle approaching a pedestrian within any marked or unmarked crosswalk shall exercise all due care and shall reduce the speed of the vehicle or take any other action relating to the operation of the vehicle as necessary to safeguard the safety of the pedestrian.

(d) Subdivision (b) does not relieve a driver of a vehicle from the duty of exercising due care for the safety of any pedestrian within any marked crosswalk or within any unmarked crosswalk at an intersection.

Wow, those are some strict traffic laws. In NYC, you learn to make turns while weaving in and out of pedestrians crossing at the crosswalk!

There are times when I will be making a turn from a street to an avenue in midtown Manhattan and there will literally be a hundred people crossing the street (and there are about 4-5 lanes for them to cross). If I see pedestrians in lanes 1 and 2 coming from one side and the people on the other side have gotten to lanes 4 and 5, then I take lane 3. Otherwise, you won't get anywhere in this city.

should of told the cops, "let me go, i could be the one operating on you or your family member in the future". ok maybe not. i heard cops have a quota to meet at the end of the month. maybe he wasnt giving out enough tickets??

I believe the US Cop inflation is at fault for causing unnecessary ticketing to the general public. I had my share of parking & speeding tickets, and it’s no fun being stopped on the side of the road, made to look like a violator.

That’s why I have to say; Italy has once again made driving a pleasure for me, from winding roads to almost non existent law enforcement, its all good here. These are the roads your BMW were built upon.

But, watch out for the Carabinieri (Italian Military Police), by law they are allowed to shoot their trusty machine guns your way, if you don't stop for the lollipop (hand held stop sign).

If you maintain your story (left turn into lane 1, while pedestrian was near the curb in lane 2) then you have a pretty good chance as long as he cited you for 21950(a).
I heard the CHP officer in traffic school a long time ago say in relation to quotas "NO, I do NOT have any quota, I can write as MANY tickets as I want."
