Contracts law in most states recognizes that while the intent is for the agreement to be executed perfectly as written, unforeseen circumstances may occur that prevent it. Force majeure (acts of God) are the most prominent example, and most case law takes from that in discouraging either party from taking advantage of unforeseen circumstances to try to maximize their gain. As the party that's technically in the right you may not be happy about having to give something up to complete execution of the agreement, but that's what case law encourages. Small claims statutes in particular emphasize this with the intent being the court system isn't clogged with petty (low $ value) disputes. A really high quality respray on a Z4 bumper cover is less than $500, and this is exactly the kind of dispute the statutes encourage being settled privately.

The fraud statement is made by the seller. The amount of the contract is 5680. The balance will be paid minus half the repair as soon as we have an agreement and a secure way to transact this.

Does this amount include what you owe for the PPI and the express mail cost for the documents? The good thing is you have no way to register the car(and drive it legally) until you receive the title.

You guys don’t understand who the buyer is til you do business with him. He made me jump through many hoops and suggested l pay half of everything that was a cost to him not being present to look the car over and ship it. l told him upfront that the dealer l bought it from had the front bumper re-sprayed BEFORE l EVEN BOUGHT THE CAR. l don’t know what makes him think l could possibly hide a paint defect when l let his friend come to my house and inspect it. The dealer even noted the wheels where repainted so they checked the car well enough.
Thanks for not paying the PPI again btw.
l specifically told him I’d sign the title and then he pays me the balance, obviously to protect me from this very issue of him not paying, then send the title overnight.
l still have the car shipper inspection sheet and much more evidence of what l had to go through for this buyer to attempt to screw me over for his idea of taping the bumper.

His transport guy gave me this upon picking up the car to ship it from my garage.
l didn’t even drive the car out of my garage after his buddy inspected it.

How did I miss this thread? Damn, I guess I need to linger around more to catch some drama.

any of the old timers remember Villa? What happened to that guy? You could count on him to stir some sh#$ up on a daily.

On my 2 cents about this situation, Op/seller, you were too nice. For your own sake, don't ever agree to something like this again. and to the buyer, being on an island won't make you a tough guy. Pay up! a bumper respray is 500 bucks anywhere. no need to hold 7k hostage.

Jet Hot Villa? Got banned permanently long long ago. But you're right, that guy was good for a crazy story almost daily. Lots more going on then too here prior to FB stealing eyeballs too. Seems like that was another world long ago in some ways.

This thread just poped into my head and I headed back to see if there was a post I missed.

WTF? How did he sell it without a title? I wish the OP would return and tell us what happened.

EDIT: PM'ed the OP and he made a deal with the guy to take $500 off for the bumper just to get the deal done. Too bad he had to give in, but what can you do when you are in Canada and the buyer is in Hawaii with your car and still owes $6k?
