Do you know if this has the ESS U.S. or Euro tune?

Euro tune has to be reflashed to pass OBD2 emissions.

hmm. I have the remote USB tuner, and the flash card from ESS. They flashed it for euro headers, and there are no check engine lights. Because there are no catalyctic converters, I don't think it will pass OBD2 emissions. I usually stick to only one mechanic wherever I live, and that helps me pass iffy inspections.
I do have the OEM section 1 with cats available for free.

If you want to ask Roman about it, it was order #3647

Two of my Z4M's have Euro tunes and won't pass OBD2, even with cats. The Euro tunes don't have the same readiness check as the U.S. tunes. FWIW, ESS has a U.S. tune that will pass OBD2, even without cats.

I'm moving overseas for 1-2 years, and none of my cars are legal to bring (run on meth, Euro tunes, loud exhaust, modified headlights, etc.). On top of that, my G-Power Z4M needs maintenance (rod bearings, Vanos rebuild, and refurbishing of some wear and tear items on the supercharger). My other Z4M is mint, and I won't ship it. I had planned to buy a temporary car to use, so if this can be made legal fairly easily and the price is low enough...

it also has adjustable height suspension, and relatively quiet exhaust....

since the flash tuner is included, it would be inexpensive to get re-flashed by ess for whatever you want.

No warning lights illuminated. Most of the time the start up is perfectly smooth. Sometimes it fluctuates between 1500 and 1200rpm for like 10 seconds (no more), and evens out. I figure its just a small quirk of the tune.

I've had the CEL come up for the secondary air pump, which is now blocked off savings 5lbs and some room in the engine bay. That came on once every few months, and then I'd re-set it with a basic OBD2 code reader. Hasn't come on at all this year.

Someone just got a steal and it wasn't me because I'm moving next week for a 1 year relocation. If this auction was a week earlier I would've been very tempted to buy it and just store it for a year until I get back, then sell my 3.0i. Damn, and to think I paid only $3k less for my 3.0i last year and already put $3k into it. Sigh... coulda had an awesome Z4M for the same price.
