ESS VT-455 kit & OBDII

Guys, I've just sent in the P&S on another 2006 Z4 MR - the last one succumbed to an early violent end 2 weeks ago. This time around, I am looking at adding a little more giddyup. I don't track - it's my daily driver, so I'm looking for just a bit more "spirited" fun. I fully understand that suspension upgrades will follow, but that's for another thread.
After reading tons of threads here and on the other Z4 forums I belong to, ESS Tuning seems to be the most popular option, and the VT-455 is more than enough boost for me (at this time). My question is this: Here in New Hampshire we have OBDII testing as part of our annual state inspection, and ESS's web site puts in the following disclaimer at the bottom of the page:

Not designed to pass US OBD2 readiness testing

So - those of you that do have an ESS FI kit, have you had any issues with passing state inspections?
