You are part of the problem.
I hope you get nothing and the lawyer bends you over as well. This bullshit lawsuit over every inconvenience crap is stupid. You should have brought a check and paid for it that way. They cannot say no if you bring them the money for the car. Your fault for listening to their BS. They were probably just jerking you around cause they got a better offer. Deal with it. Life is not fair.

Advice?
There are a limited number of days we're all allotted, why waste your time (and money) here? It takes energy, emotion, time--and takes that away from the rest of life that's worth living. Why let other people have such a dramatic effect? Why cede that power over oneself to others? Let it go, move on, life's too short. I'm sure there are plenty of other dealers willing to work with you. Have your financial ducks in a row, then find some other place, get the car you want, and enjoy it! Drive away with a smile! The alternative is making yourself and everyone around you miserable. Going after a fly with a nuclear bomb kind of does that. It's your choice. or . It's up to you. |

Yes: you got screwed. BUT, I'm confused as to what you really want? Even if they found your perfect car at this point, you still want to deal with them and give them your money???? Wouldn't the best retribution be to take your business elsewhere, (and then if you want, discuss with the manager that you ended up buying the car at a different dealership)??
Life is precious, its not worth stewing over petty crap like this. Yes it sucks, but refocusing your energy on positive ventures will pay dividends later. Last edited by ncnmra; 11-16-2012 at 06:19 PM.. |

If you insist on going through with this lawsuit can you please change your brand of choice, perhaps to a Porsche. We've got enough asshat, entitled BMW owners screwing things up for us already.
Seriously, move on with your life. |

1. Customer with excellent and accessible credit 2. Customer paying with CASH, as in green backs 3. Customer paying with "check" 4. Customer paying with "check" without verifiable credit 5. Customer with no accessible credit And if what you say is true, they sold the car you want to customer #1, someone with verifiable and accessible credit, what can you really do? The guy they sold the car to was far less of a risk for them, plus he/she was FINANCING. If you're serious, first I'd suggest you ask your questions about the car you're buying in the forum(s) that has more people who likely would have had the same sort of experience dealing with the same sort of car, like, oh, I dunno...The E9X forums. Second, the question now remains...If you were to walk in to any other dealership, are you going to have to deal with the same stuff, i.e. having your credit frozen and inaccessible. THAT is going to determine what your next step is, IMO. IF I were in your shoes, which I am not, I'd go find another car in the market, DETERMINE if I can afford the car, and if you can't get your credit issue resolved, walk in and be prepared to purchase the car with a bank check before someone with qualified credit walks in and sees the same car.

So the act of buying a car really stressed you, but now you want to engage in civil litigation spending tens of thousands of dollar with no clear goal in sight. You don't think that will be a little stressful?

I, for one and probably not alone, am tired of your complaints about something that could have have easily addressed form the outset. Now you want to sue! For freakin' what? Inconvenience! You have already posted that you've purchased another ride, enjoy that car and move on, nothing more to do here or anywhere else!

If you found a lawyer to take your case, let me guess;
1. He/she will not do anything until you give them a $2500 retainer, and agree to their hourly rate. ...or... 2. Your attorney drives a 9 year old Elantra. Best of luck. |

Like zgood4u notes, this thread was started 2 days after the OP created a thread about how he'd found--and purchased--a CPO car from another dealer E90post. The timing aspect adds yet another dimension to this sad thread.
OP, I'm going to turn my back and walk away, and I'll just wish you well. ***adds OP to ignore list*** |

Guys relax... i was just kidding about getting lawer.
anyway here is the story and i got very good deal because i did listen your advise. Anyway long story short; I went to dealer other day and test drove few cars and i liked CPO 2009 335i Sport Package "Fully Loaded" except Nav; 19,890 Miles., purchased maintenance till march 2015 for $2200. Car was priced "ePrice" for $30,300, Spoke to advisor and offered him $27,500, he spoke to Manager and that he agreed, financed through BMW and i will save $900 in 2 months, because BMW will pay first two payments of "$500" each month. So basically car was $26500. I was so calm and i was being nice to them, i didnt scream on anybody what web learned from this that some times we shouldnt loose control of ourself and respect people and be nice and use your time/energy in positive things... what do you guys think about the car. its damn fafst @The HACK.................FYI: My credit score is 814 Thank You Guys for Good advise. you guys are the BEST Last edited by SHEEDI; 11-18-2012 at 09:22 PM.. |

@Finnegan.... i posted that 328i in 3 Series forum because i left deposit on the car and i thought i got the car already and i was so excited and posted pics on 3-Form but manager broke that sad news "eventually good news" on thursday that they have sold the car already. My advisor assured me everyday through emails/phone that car will be mine and the car is still there adn let him work on my financial application because he didnt want me to loose first two payments BMW will make. by the way they fired that advisor the one who was dealing with me.

Wow. All this stress over an E90 3 series.
They must be really hard to find because they only made 2,147,247 of them between 2005 and 2009 and there are only a mere 13,825 of them on autotrader right now so they must be getting pretty rare. Mabey we need to hire a private investigator instead of a lawyer to find out where the other 2,133,422 of them went.
