Yeah, this isn't your usual posting style. Sounds like weren't cited or anything, which could mean you caught a break and should be thankful, or the officers saw you as pushing the legal limit and they were playing it safe.

"Impaired" probably means you're on the border of the legal limit and he cut you a break. If your g/f drank just before she left, the alcohol didn't get into her system as fast as yours, which is typical for females and liquor processing. Give her another 30 minutes and she would have blown a higher BAC.

Embarrassing, but since it wasn't the back of the police car and just the passenger seat....
Using the BAC chart for men, and the highest weight (240), your estimated BAC should have been about .01%. (BAC for 2 drinks is .03% at 240 lbs, subtracting .01% for each 40 minutes after consuming the drinks.).\ That's not really "impaired" as impairment begins at .02% or so. but a lot of factors can affect processing rate and so on. Nevertheless 2 drinks 2 hours before shouldn't have put you at a "sit in the passenger seat level". I suspect either not that much time passed or there was more alcohol in each drink than you thought. (Generous bartender?) Mixed drinks are harder to really call "a drink" as they can vary so much. Did someone measure exactly 1.25 oz into each drink? My guess is it was more whether it tasted watered down or not or they were large glasses. Beer is pretty easy when it's a bottle since it's a stable measure, wine a bit harder as most people don't measure out 5 oz. of wine. I'm glad you got a warning and nothing else happened (cops, or to you if you were indeed a bit unintentionally impaired). Last edited by Finnegan; 06-26-2011 at 09:48 PM.. |

You're lucky you got decent cops. In the future, the #1 rule is don't drink and drive. The #2 rule is NEVER EVER EVER BLOW (unless you have had zero to drink) -- A good lawyer can get you off unless you give up the evidence yourself by blowing (or performing any other "sobriety" test).

I have never drank alcohol and driven. It's not worth it, even monetarily lol. You should have been fine though, especially at 270; I dont know what that was about.

well, 1st.. You should not be announcing about being 6'2" and weigh in at 270 lbs. You "may" want to start adding some more cardio to your exercise routine.
Actually, I think cops were pretty cool for both of you. They gave you an out.. and you were able to get home without the arrest, car impound for DUI. It's always a worry when it comes to drinking anything and driving. You may feel completely fine, but still be close enough to scoring badly on the test. We have the DUI checkpoints round Austin from time to time, they also have nights/weekends where you cannot refuse to take the test if pulled over.

Not automatic conviction, automatic license suspension. Which, if there's a doubt in your mind about your sobriety state, a suspended license (which again, a lawyer can get back to you) is much much preferrable to a DUI/DWI conviction.

Depending on how hard you work during the week and your normal sleep schedule, fatigue could be a factor too. It was 3 AM. So many accidents are caused by drivers falling asleep at the wheel (and so many people drive tired) that I think fatigue is going to become the new evil; cops are going to try and purge it much like drinking and driving. Some areas have already started cracking down on it and treating it like a DUI - driving under the influence of fatigue.

I never have more than one drink in a night if there's even a hint that I am going to be driving.
Glad you weren't at .08, never worth it. |
