I signed something actually now that I think of it so Im probably screwed. Oh wait, I am screwed. I just found out that my own insurance company will not cover this either. They said since its a pre existing issue that they cannot cover it but I purchased the vehicle brand new and they have been my only insurance provider so how can they refuse to do that?? My adjuster said my lights are from a junk yard and not my original lights as well. So theyre broken used lights from somewhere. Its at BMW of Manhattan for all of you tristaters and the car was at JMK BMW & MAC body shops. Somehow, somewhere- someone f*cked me over royally. I have to pay to get my car put back together and drive away with nothing fixed now. :/

You had thought about having halos installed a while back.
Did you ever go ahead with that?
If you did, that could be where these lights came from.

Oh the irony! I thought about it but didn't want to void my warranty. Ha!!! But if I can get these resealed somehow. I will send them over to get done as I am going to have to buy a new set of lights regardless.

Well I've never read them either, but I assume all those papers they have you sign when you bring the car in include that.

Your insurance has to cover it, it falls under theft and vandalism. It's just a matter of if you want to claim it and pay the increase in premium.

Again, you're being too complacent and you need to be much firmer with the parties involved instead of rolling over.

The Dallas unit is from an 04 which has the orange hockey sticks. Wont match an '06+car, the others don't say if they are HID or not.

And once again, I'm not. Lol. My adjuster hasn't finalized denial of my claim. I called him earlier because it doesn't make sense for them not to fix them under my full coverage policy. If denies it then theft/vandalism is my next argument. This is getting annoying.

Phone your insurance company, and then the BMW dealer, using your cell from the front steps of your lawyer's office. Explain to each of them that you are thinking about going inside for a nice chat, depending of course on what their answer is.

  1. you are the original owner.
  2. You have only had one insurance company for the entire time you have owned the car.
  3. That insurance company selected the bodyshop that ripped you off, or authorized them.

In that case, the insurance company is responsible. Plain and simple.

I selected the body shops both times. Supposedly bmw certified/trained or whatever. I found them through the bmw forums as they came recommended. :/

They could have been switched out during any of your mods (like that black vinyl you had put on your roof)... right?

Lol no....the only time my car has been left unattended [by me] is at the dealer and both body shops for collision related reasons. But thats the idea. Swap my headlights, collect the insurance money, replace mine with a pair of sh*tty ones and pocket the difference. Why would I notice when the damage wasnt to the front? :/

IF your insurance company refuses to pay, pay an attorney for an hour of their time and have them send a letter to the ins company. They will always settle a small claim to avoid litigation. Sucks to have to do that but sometimes you have to force them to do the right thing.

No kidding. Thankfully I have a good repor with my dealership here and I am sure they would help me out a lot before losing a guaranteed future vehicle customer as well as someone who gets 3 vehicles serviced there!

So three weeks later, Im finally picking up my car. My insurance company covered the lights under theft and $700 later, I will have my car back tonight. The dealer charged me an additional hour to "diagnose" the problem which is complete BS. At this point, I dont care, I just want my car back!

That's been quite a story.
Haven't seen you on here in ages, granted I'm not on much myself either.. but Wow.

I'm glad the insurance company is covering it under theft, and I hope all works well for you.

The sad and silly part is that the headlight fog can be solved by simply changing the rubber seal on the back panel of the headlight housing, as it can get worn and hard.

They only sell the rubber seal with a new back cover, which is a little silly, but that's how I fixed the issue on mine.

Even after I fought to get the dealership to replace the headlight under warranty.
They didn't replaced the back cover as I had after market HID's, so the seal didn't get replaced. Which makes it a miracle in itself that they didn't blame my HID kit and went ahead and replaced the housing anyways. Ended up just buying the rear cover and new rubber seal myself, but the brand new head light took care of the moisture stains.

Glad you have your car back, Lana.
