The dealer is essentially saying its ok but BMW is saying that it will void the entire warranty which seems a bit OTT

I ran an Eisenmann Race on mine for about 6-9 months and had no issue with the two dealers I use. In the end i took it off as I was not keen on the level of drone it produced at cruising speed on a daily drive.
It did make a great sound.....
